Carlyle Financial is an Equal Housing Lender. All loans are offered and arranged through third-party lenders and are subject to credit approval and other conditions. This website and our services are intended for residents of California and are not a solicitation to extend credit or conduct business in jurisdictions where we are not licensed.

1. Acceptance of Terms

By accessing or using Carlyle Financial’s website (the “Site”), you agree to be bound by the following Terms of Use (“Terms”). These Terms constitute a legal agreement between you and Carlyle Financial, Inc. (“Carlyle Financial,” “we,” “us,” or “our”). If you do not agree with any part of these Terms, please do not use this Site. Navigating beyond the homepage or clicking any link on our Site signifies your acceptance of these Terms. We reserve the right to update or modify the Terms at any time. If we make changes, we will post the latest version on this page and update the "Effective Date" above. Your continued use of the Site after any changes constitutes acceptance of the new Terms.

Consent to Communications: By providing your contact information (such as phone number or email) through the Site, you consent to receive communications from Carlyle Financial. This includes emails, phone calls, and SMS/text messages (which may be sent via automatic telephone dialing systems) about your inquiries, transactions, and our services. You agree that we may send you marketing messages (e.g., interest rate updates, new services) unless you opt out. Message and data rates may apply for SMS. You can opt out of promotional emails by using the unsubscribe link in the email, and you can opt out of texts by replying “STOP” or contacting us at any time. If you choose to create an account or provide contact information on our Site (for example, to start a loan application or sign up for updates), you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized use of your account or any other breach of security.

3. Prohibited Conduct

  • Unlawful or Abusive Use: Using the Site for any purpose that is illegal or beyond the scope of its intended use (such as to stalk, harass, or harm another individual, or to advocate any violent or unlawful activity).

Violation of any of the above can result in termination of your access to the Site (without prejudice to any other remedies available to us by law).

4. Intellectual Property Rights

Some jurisdictions do not allow certain limitations of liability, so some of these limits may not apply to you. In any case, our liability will be the minimum allowed by applicable law.

This limitation of liability is a fundamental part of the agreement between you and us, and shall apply to the maximum extent permitted by law, even if a remedy fails of its essential purpose.

10. Indemnification

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you. If we do so, you agree to cooperate with our defense of such claim as reasonably requested. You will not settle any claim that affects Carlyle Financial without our prior written approval.

11. Dispute Resolution (Arbitration & Governing Law)

Quick Summary: PLEASE READ THIS SECTION CAREFULLY. You agree that most disputes will be resolved through binding arbitration on an individual basis (not in court, and no class actions), unless you opt out of arbitration within 30 days. California law will govern these Terms.

Governing Law: These Terms and your use of the Site are governed by the laws of the State of California, U.S.A., without regard to its conflict of laws principles. This means that the interpretation and enforcement of these Terms will be under California law, even if you access the Site from outside California.

Agreement to Arbitrate: Except where you exercise the opt-out option described below or where prohibited by law, you and Carlyle Financial agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site exclusively through final and binding arbitration. This includes disputes about the validity, enforceability, or scope of this arbitration agreement. You are thus waiving your right to a court trial and to have any dispute heard by a judge or jury (except for matters that can be taken to small claims court as noted below).

Arbitration Procedures: The arbitration will be administered by a neutral arbitration provider, such as the American Arbitration Association (AAA), under its Consumer Arbitration Rules, unless otherwise agreed. The arbitration may be conducted in person in Los Angeles, California, or another mutually agreed location. At your election, arbitration can also be conducted remotely by telephone or video conference. The arbitrator will have authority to award the same damages and relief that a court could, except that the arbitrator may not award relief on a class, collective, or representative basis (see “Class Action Waiver” below). The arbitrator will issue a written decision explaining the essential findings and conclusions. Judgment on the arbitration award may be entered in any court having jurisdiction.

Class Action Waiver: All arbitrations shall proceed on an individual basis. You and Carlyle Financial waive any right to bring or participate in a class action, consolidated, or representative proceeding against each other. The arbitrator is authorized to resolve only your individual disputes and may not combine or consolidate claims of other individuals. If this class action waiver is found unenforceable, then the entirety of the arbitration agreement shall be null and void (but the rest of these Terms will remain in effect).

Opt-Out Rights: You have the right to opt out of this arbitration agreement. If you do not wish to be bound by the agreement to arbitrate, you must send a written opt-out notice to us within 30 days of the date you first accept these Terms (for example, the first time you use our Site after these Terms go into effect). Your opt-out notice must include your name, address, phone number, and a clear statement that you do not agree to arbitrate disputes with Carlyle Financial. You should send your opt-out notice by email to info@carlylefinancial.com or by mail to: Carlyle Financial, Inc., 10880 Wilshire Blvd. Ste 2100, Los Angeles, CA 90024, Attn: Arbitration Opt-Out. If you opt out of arbitration, you will retain your right to pursue remedies in court, and neither you nor Carlyle Financial can insist on arbitration for the matter.

Exceptions: Notwithstanding the above, either party may choose to bring an individual action in a small claims court for disputes or claims within that court’s jurisdiction. In addition, nothing in this arbitration agreement will prevent either you or us from seeking injunctive relief (e.g., a court order to stop misuse of intellectual property or unauthorized access to data) in a court of law.

Enforcement and Severability: This Section 11 is governed by the Federal Arbitration Act and evidences a transaction involving interstate commerce. Except as provided in the Class Action Waiver above, if any portion of this Section is found unenforceable, that portion shall be severed, and the remainder shall be enforced.

12. Equal Housing and Regulatory Compliance

Carlyle Financial is committed to fair lending and ethical business practices. We do not discriminate in any of our lending or brokering activities on the basis of race, color, religion, national origin, sex, marital status, age, the receipt of income from public assistance, or any other characteristic protected by law. Our policies and practices are consistent with the Equal Credit Opportunity Act (ECOA) and the Fair Housing Act, among other laws. We are proud to be an Equal Housing Lender, conducting our business in compliance with all applicable federal and state regulations for mortgage lending and brokerage.

For reference, Carlyle Financial, Inc. is licensed by the California Department of Real Estate (Broker License #01941702) and maintains a Nationwide Mortgage Licensing System (NMLS) ID #1680556 (which can be verified on the NMLS Consumer Access website).

Geographic Restrictions: This Site and its content are not intended as an offer to provide mortgage brokerage services in any jurisdiction where Carlyle Financial is not licensed or operating. We currently conduct residential mortgage brokerage primarily in California.
